The petitioner seeks bail in Sitamarhi P.S. Case No. 121 of 2021, registered for the offence punishable punishable under Sections 30(a), 36 of the Bihar Prohibition and Excise Act.

112.200 litres of illicit Nepali Saufi liquor has been recovered from two jute bags which were allegedly thrown by this petitioner along with co-accused and identified by the local Chowkidar.

It is submitted that no recovery has been made from conscious possession of this petitioner and has been made accused in this case merely on suspicion. Petitioner was simply

Patna High Court CR. MISC. No.69977 of 2021(2) dt.22-12-2021 2/2 driving the vehicle and was not aware about the nature of consignment. Petitioner has no concern with the seized liquor. Petitioner is in custody since 11.10.2021. Investigation is complete.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and three cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise Act, Sitamarhi in connection with Sitamarhi P.S.
