Petitioner apprehends arrest in a case registered for the offences punishable under Sections 498A, 379/34 and other allied sections of the Indian Penal Code.
As per prosecution case, all FIR named co-accused persons along with this petitioner tortured and harassed the informant for non-fulfillment of demand of dowry. Petitioner is husband of the informant.
Learned counsel appearing for the petitioner submits that there was matrimonial dispute between the parties, which as been resolved by way of compromise and in terms of compromise petition, both the parties have agreed to live separately permanently and the alimony, as fixed, Rs. 8,50,000/-
Patna High Court CR. MISC. No.57489 of 2022(2) dt.21-12-2022 2/2 has already been paid to the father of the petitioner which would be apparent from the contents of the compromise petition vide Annexure-2. It is further submitted that in terms of the compromise between the parties Divorce Case No. 377 of 2022 has mutually been filed before the learned court below by the parties.
Considering the fact that the dispute has been compromised between the parties, let the above named petitioners in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in Chatauni P. S. Case No. 124 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
