The petitioner seeks bail in connection with Nasariganj (Rajpur) P.S. Case No.09 of 2015 registered under Sections 392 and 411 of the Indian Penal Code besides Sections 25(1-B)A, 26 and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended by the police rather the name of the petitioner has been disclosed to the police by the co-accused Vikash Kumar Singh alias Nepali, who was apprehended by the police and on whose possession one country made pistol alongwith three live

Patna High Court Cr.Misc. No.48405 of 2015 (2) dt.09-11-2015 2/2 cartridges and looted mobile set are said to be recovered. The petitioner is in custody since 13.07.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, Judicial Magistrate, First Class, Bikramganj, Rohtas, in connection with Nasariganj (Rajpur) P.S. Case No.09 of 2015.
