2. The petitioner is in custody since 17.03.2023 in connection with Tekari P.S. Case No. 456/2022 registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

3. As per the prosecution case, for selling the family land, the petitioner killed his 75 years old father by strangulating him. The informant of the case is wife of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner informant is the first wife of the

Patna High Court CR. MISC. No.59654 of 2023(3) dt.08-11-2023 2/2 petitioner whereas the petitioner lives separately with his second wife. He next submits that there is no eye-witness to the occurrence.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He has submitted that during investigation, the allegations have been found to be true and the petitioner has been chargesheeted.

6. Considering the facts and circumstances of the case and also the serious allegations levelled against the petitioner and particularly the fact that the petitioner being son has killed his father, I am not inclined to grant bail to this petitioner. This application for is dismissed.
