JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2015 Heard learned counsels for the petitioner, informant and learned counsel for the State The petitioner is languishing in custody since 31.08.2015 in connection with Majorganj P.S. Case No. 60 of 2015 for the offences instituted under Sections 498(A), 379 of the I.P.C. and 3⁄4 of the Dowry Prohibition Act.

The prosecution story, in brief, is that the informant was married with accused Pawan Sah on 09.05.2014 and she came to her Sasural where her in-laws including her husband started to demand cash Rs. 2,00,000/- from her parents for business and on refusal by the victim/informant, she was started to torture and cruelty and lastly, she was ousted from the matrimonial house

Patna High Court Cr.Misc. No.50892 of 2015 (2) dt.22-12-2015 2/2 when the said demand of dowry was not fulfilled by her parents. A joint prayer has been made on behalf of learned counsels for the petitioner and the informant that the petitioner and the informant are ready to stay together.

Considering the submissions made on behalf of the parties, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Majorganj P.S. Case No. 60 of 2015.

On the date of release, both the parties shall be present in the court and the learned court below will see that both the parties have left together. If the petitioner retracts from the submissions made before this Court then the bail bond furnished by the petitioner shall not be accepted by the learned court below. U.K./- (Sudhir Singh, J) U T
