ANJANA MISHRA ORAL ORDER 18-08-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Turkauliya (Banjariya) P.S. Case No. 530/2016 for allegedly having committed the offence under Sections 147, 148, 149, 302, 379, 427 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that the allegation is against 27 persons and also upon 160-170 unknown persons. So far as the present petitioner is concerned, he is said to have instigated one Pamu Singh to shoot, which resulted in death of Heeramati Devi. It has further been submitted that there is a dispute regarding the land and petitioner has no connection with the said Pamu Singh or Banka Singh. It is further submitted that

Considering the facts and circumstances of the case, let, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya (Banjariya) P.S. Case No. 530/2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
