JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,324,326,379,354 and 384 of the Indian Penal Code. The prosecution case is that the accused persons started constructing thatched house on the purchased land of the informant, on protest being made the accused persons assaulted the informant when her son and husband came to rescue they were also assaulted. The informant went to the police station but on return she found that her daughter and daughter in law and Rina Devi have also been assaulted and cash and gold chain were snatched.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.54673 of 2015 (2) dt.03-12-2015 2/2 that for the occurrence of 20.4.2015 the complaint was filed on 25.4.2015 which came to be registered as police case on 11.7.2015. The injury of the informant side has been found to be simple. There is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with K. Hat (Hahayak ) P.S. Case No.453 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
