Petitioner seeks bail in Kahalgaon (Shivnarayanpur) P.S. Case No. 153 of 2020, registered for the offence under Sections 363/365 of the Indian Penal Code, but later on, Sections 302, 120B, 201 of the I.P.C. and Section 27 of the Arms Act were added.

As per the F.I.R., co-accused Chiku Yadav kidnapped the brother of informant and thereafter, in connivance with other co-accused persons, committed his murder.

Petitioner is not named in the FIR. Name of the petitioner has transpired during investigation in the confessional statement of co-accused Chandan Kumar and Bipin Kumar. It is further submitted that co-accused Chandan Kumar has already been granted bail by this Court, vide order dated 29.07.2021 passed in Cr.Misc. No. 11985 of 2021 (Annexure 2). Petitioner

Patna High Court CR. MISC. No.69468 of 2021(2) dt.07-03-2022 2/2 is in custody since 07.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th A.D.J., Bhagalpur in connection with S.T. No. 451 of 2021, arising out of Kahalgaon (Shivnarayanpur) P.S. Case No. 153 of 2020.
