====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-12-2022 Heard Mr. Sudhanshu Shekhar, learned counsel for the petitioner and Mr. Bharat Lal, learned Additional Public Prosecutor appearing for the State.
Petitioner seeks regular bail in connection with Sakra P.S. Case No. 462 of 2020 registered for the offences punishable under Sections 147, 148, 149, 302, 448, 323, 307, 427, 354(A) of the Indian Penal Code and Section 27 of the Arms Act.
This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 24.03.2022 passed in Cr. Misc. 35080 of 2021
Patna High Court CR. MISC. No.59158 of 2022(3) dt.07-12-2022 2/3 with liberty to renew his prayer for grant of regular bail after six months if the trial does not show any progress. The allegation against the petitioner is that he inflicted knife blow on the chest of the informant, due to which, he died.
Learned counsel for the petitioner submits that the petitioner is in custody since 13.9.2020 and the trial has not shown any progress since the last rejection of the bail application of the petitioner.
This Court vide order dated 9.11.2022 had called for a report from the trial court regarding stage of trial and in pursuance thereof, the report of learned 11th Additional Sessions Judge, Muzaffarpur, dated 25.11.2022, is on record and from perusal of the same, it appears that charges have not been framed against the petitioner and next date fixed for framing of charge was 29.11.2022. Taking into consideration the period of custody of the petitioner and tardy progress of the trial, I am inclined to grant regular bail to the petitioner, after framing of charge, if the same has not already framed.

No.59158 of 2022(3) dt.07-12-2022 3/3 released on regular bail, after framing of charge, on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XII, Muzaffarpur, in connection with Sakra P.S. Case No. 462 of 2020 subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
