2. The petitioners apprehend their arrest in connection with Khudaganj P.S. Case No. 30 of 2011, POCSO Case No. 65 of 2024, registered for the offences punishable under Section 363, 366A and 34 of the Indian Penal Code later on Sections 372, 373, 376, 120(B)/34 of the Indian Penal Code and Section 4/6 of POCSO Act and Sections 3/4/5/6 of Immoral Traffic (Prevention Act) is added.
3. As per the allegation, the minor daughter of the
Patna High Court CR. MISC. No.64357 of 2024(5) dt.10-02-2025 2/2 informant was enticed away by the co-accused, Jasima Bano and Sanno Bano.
4. The learned counsel for the petitioners have submitted that the petitioners are not named in the F.I.R., no evidence emerged against the petitioners during the course of investigation and the final form was submitted against them. He has further submitted that the petitioners have been implicated in this case after 13 years of occurrence.
5. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-7cum Special Judge, POCSO, Bihar Sharif, Nalanda in connection with Khudaganj P.S. Case No. 30 of 2011, POCSO Case No. 65 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
