This application has been filed for modification of the order dated 28.09.2022 passed in Cr. Misc. No.52131 of 2022 by this Court, by which the petitioner has been granted bail with certain conditions.

Learned counsel for the petitioner submits that the petitioner has been granted bail with certain conditions including condition no. (i) 'that the bail bond of the petitioner will be accepted only after framing of charge, if not already framed'. However, there is no chance of framing of charge in near future and the bail was granted to the petitioner on the ground that he has to appear in B.A. Part-III examination

Patna High Court CR. MISC. No.54239 of 2022(2) dt.12-10-2022 2/2 scheduled to be held from 14.10.2022 and if this condition is not waived, the petitioner would not be able to appear in the examination.

Having regard to the submission made on behalf of the petitioner, the condition no. (i) imposed regarding acceptance of the bail bond after framing of charge is waived and stands deleted from the conditions.

Accordingly, the order dated 28.09.2022 is modified to the aforesaid extent only.

This application stands disposed of.
