JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Section 307 and other allied sections of the Indian Penal Code. The allegation is that the petitioner gave Farsa blow on the head of informant causing incised wound 3" x 1/6". The petitioner submits that there is a case and counter case. The prosecution side has caused injury to his side as well. He submits that the occurrence took place on account of land dispute. Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. His prayer for grant of anticipatory bail is rejected. However, if the petitioner surrenders before the court below (Additional Chief Judicial Magistrate, Benipur, Darbhanga) and prays for regular bail, the same would be disposed of on the same day also taking
