Petitioner apprehends arrest in a case registered for the offences punishable under Section 306/34 of the Indian Penal Code.

Prosecution case, in short, is that petitioner along with other F.I.R. named accused person used to send obscene messages on the mobile of the daughter of the informant due to which she felt depressed and on 27.05.2022, daughter of the informant committed suicide by hanging herself. Learned counsel appearing for the petitioner submits that petitioner and the deceased studied in the same school and

Patna High Court CR. MISC. No.71649 of 2022(5) dt.22-06-2023 2/2 were classmates. They had a love affair and they used to talk to each other regularly on mobile. It is next submitted that father of the deceased used to brutally assault her whenever he caught her talking to the petitioner on mobile and one day, out of anger, deceased committed suicide. Petitioner has got clean antecedent. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P. S. Case No. 481 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
