Mr. SMT. MADHURI LATA ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Jehanabad P. S. Case No. 183 of 2016 registered for the offence punishable under Section 7 of the Essential Commodities Act. The petitioner is the owner of Auto Rickshaw bearing registration no. BR25P-7528 and Ravi Chand Das the driver of the Auto Rickshaw was apprehended and from that Auto Rickshaw cylinder of LPG was recovered.

Submission is of false implication and that the petitioner has entrusted his Auto Rickshaw to the driver to ply on the road on hire and he has no knowledge of using LPG Cylinder in Auto Rickshaw. The driver has already been enlarged on bail

Patna High Court Cr.Misc. No.46958 of 2017(3) dt.17-10-2017 2/2 vide B. P. No. 550 of 2016, similarly situated co-accused Sahanawaj has been allowed pre-arrest bail vide Cr. Misc. No. 8646 of 2017 and as such the petitioner deserves sympathetic consideration.

Learned APP fairly submits that other owner of Auto Rickshaw has been allowed pre-arrest bail.

In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Jehanabad P. S. Case No. 183 of 2016, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
