JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366(A), 506/34 of the Indian Penal Code. It is alleged that daughter of the informant has been kidnapped by all the F.I.R named accused persons including the petitioner.

It is further submitted that the informant in para 38 of the case diary has admitted that petitioner is not involved in the present case. A supplementary affidavit has been filed to the effect that good sense has prevailed between the parties and both sides have compromised the matter. The compromise petition is annexed as Annexure-2 to the supplementary affidavit. The petitioner is languishing in custody since 14.07.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Court-cum-Additional Sessions Judge-VI, East
