JUSTICE SHIVAJI PANDEY ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Bihiya (Bahoranpur O.P.) P.S.Case No. 99 of 2015 registered u/s 25(1B)a/26 of Arms Act. Police had arrested the petitioner and from his possession country-made pistol and 15 cartridges were recovered. It has come in the order-sheet that the petitioner was also caught along with motor-cycle. It has further been submitted by the counsel for the petitioner that the petitioner is owner of the said motor-cycle. Petitioner is in custody since 12th April 2015. Looking to the period of custody, petitioner Ranjeet Tiwary @ Ranjeet Kumar Tiwary is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand)

Patna High Court Cr.Misc. No.49969 of 2015 (2) dt.10-11-2015 2/2 with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Bihiya (Bahoranpur O.P.) P.S.Case No. 99 of 2015 after making enquiry about the ownership of the said motor-cycle and if it is found that the petitioner is not the owner, in that circumstance, the court below will not release the petitioner on bail, with the conditions that:

(i) one of the bailors will be father, mother or wife of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds, and (iii) the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
