ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.07.2019 in connection with Nawada Town P.S. Case No.617 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were made from the Bolero vehicle and not from the conscious possession of the petitioner. It is further submitted that save and except one another case in which he has already been granted bail, the petitioner has no criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.54873 of 2019(2) dt.04-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-Cum-Special Judge, Nawada, in connection with Nawada Town P.S. Case No.617 of 2018.
