Mr.Shantanu Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Piprakothhi P.S. Case No. 132 of 2017, registered under Section 304B/34 of the Indian Penal Code.

The accusation is of killing of sister of informant by her husband and in-laws due to non-fulfillment of demand of dowry by administrating poison.

Learned counsel for the petitioners submits that both petitioners are mother-in-law and father-in-law of the deceased, sister of the informant and they used to reside separate to Sahbuddin, husband of the deceased, but with ulterior motive,

Patna High Court CR. MISC. No.60940 of 2019(2) dt.15-10-2019 2/2 both petitioners have falsely been implicated in the present case but on investigation, police submitted charge sheet only against Sahbuddin, husband of the deceased, and submitted final form against both petitioners arriving at conclusion that both petitioners are not involved in the murder of sister of informant but differing with the final form, the learned court below took cognizance against the petitioners.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned J.M. Ist Class, Motihari, East Champaran, in connection with Piprakothhi P.S. Case No. 132 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
