The petitioner apprehends his arrest in Daudnagar P.S. Case No. 72 of 2021 registered for the offences punishable under Section 25(1-b)a, 26 and 35 of the Arms Act pending in the Court of learned S.D.J.M., Daudnagar, Aurangabad. As per FIR, arms and ammunition, as mentioned in the seizure list have been recovered by the police from the house of co-accused which he along with his other accomplices used to sell and purchase illegally.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the apprehended person disclosed the name of the petitioner. He submits that nothing has been

No.62109 of 2022(2) dt.22-12-2022 2/2 recovered from the possession of the petitioner and except confessional statement of co-accused, there is nothing on record against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Daudnagar P.S. Case No. 72 of 2021.
