JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 03.08.2016 in connection with Bihra P.S. Case No. 108 of 2016, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 448, 379, 427, 504 and 506 of the Indian Penal Code. Allegation against the petitioner is that he along with others have assaulted the informant and her family members. It has been submitted on behalf of the petitioner that only allegation against the petitioner is that he was also present on the place of occurrence and there is nothing to show that the petitioner has assaulted the informant and her family members and he has been in judicial custody since 03.08.2016.

Heard learned A.P.P. also.

No.53823 of 2016 (2) dt.15-12-2016 2/2 Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner has no specific role to play in the said offence, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bihra P.S. Case No. 108 of 2016.
