JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
This is an application for grant of regular bail for offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that earlier there was direction by this Hon'ble Court to the petitioner to deposit the amount and on that condition, anticipatory bail was granted to the petitioner but he could not deposit the same within the time, but now he has deposited the amount which would appear from the impugned order itself but the learned Court below has not granted bail to the petitioner on the ground that he has disobeyed the order of the Hon'ble Court and he left appearance, therefore, he had been arrested after exhausting all process against
Patna High Court Cr.Misc. No.55241 of 2016 (2) dt.11-01-2017 2/2 him. It has also been submitted on behalf of the petitioner that he is in jail custody for about five months.
Heard learned A.P.P. also.
Considering the facts and circumstances of the case and also the fact that the petitioner has disobeyed the direction for 17 years as now he is languishing in judicial custody since five months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Nawada in connection with Gobindpur P.S. Case No.23 of 1999 with condition that he will make himself available for each and every date in the Court except on some genuine reasons.
Accordingly, the application is allowed.
