JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 307, 435, 436, 427, 380, 504 and 506 of the Indian Penal Code.

Allegation in brief is that during Tajiya procession, some altercation took place between two communities and it is alleged that the petitioner was leading the other side and later on the house of the informant was looted and it was also burnt. Learned counsel appearing on behalf of the petitioner submits that allegation is not true the petitioner being Mukhiya of the Gram Panchayat has falsely been implicated in the occurrence due to political rivalry. Moreover, there is no specific

Two other cases arise out of the same occurrence were lodged and in both cases, he has been granted bail and moreover, both parties have comprised this case. Considering the aforesaid facts and circumstances, specially, no specific allegation of burning the house of the informant, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri P.K. Lal, J.M. Ist Class, Sitamarhi in connection with Kanhauli P.S. Case No.99 of 2016.
