The petitioner apprehends his arrest in connection with University P.S. Case No. 44 of 2018, registered under Sections 406, 409, 467, 468, 420 and 120(B)/34 of the Indian Penal Code.

The accusation is that on inquiry, some irregularities and tempering of marks in Tabulation Register were found, which was prepared by seven teachers named in the F.I.R. including the petitioner.

Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. but during investigation, nothing has been collected against the petitioner.

No.54368 of 2019(2) dt.30-08-2019 2/2 Further submissions is that similarly situated co-accused, Raj Kishore Thakur, who was also engaged in tabulation of marks, has already been granted privilege of pre-arrest bail by a Bench of this Court vide order dated 27.08.2019 passed in Criminal Misc. No. 53548 of 2019. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VIII, Muzaffarpur, in connection with University P.S. Case No. 44 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
