JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Maner P.S. Case No. 276 of 2015, G.R. No.3037 of 2015 for the offences instituted under Sections 147, 149, 323, 325, 341, 379, 279, 337, 504, 506 and 452 of the Indian Penal Code. The allegation against the petitioner is of assaulting on Pinki Devi with bricks, causing breaking her teeth. There she has been referred to PMCH, Patna for treatment.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He has falsely been implicated in the present case. As per the injury
Patna High Court Cr.Misc. No.54939 of 2016 (2) dt.22-12-2016 2/2 report, injury no.1 is said to be simple and in respect to the injury no.2 and 3, the opinion has been kept reserved. It is further submitted that the petitioner is ready to deposit Rs. 20,000/- in the Court below, which shall be released in favour of the victim namely Pinki Devi.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit Rs. 20,000/- in the Court below which shall be released in favour of the victim Pinki Devi and on doing so, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Maner P.S. Case No. 276 of 2015, G.R. No.3037 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, J.M. 1st Class, Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
