This application for anticipatory bail arises out of Adapur (Nakardai) P.S.Case N0. 205 of 2016, disclosing offences under Sections 147,148,149, 341, 323, 324, 307, 379,504,447 of the Indian Penal Code.

For the occurrence said to have taken place on the same date and time on 26.11.2016, two First Information Reports have been registered including the present one. The other First Information Report being Adapur Nakardei P. S. Case No. 204 of 2016, has been lodged by Sunita Devi, wife of the present petitioner. The informant and the person who received grievous injury are accused in said Adapur Nakardei P.S. Case No. 204 of 2016.

Patna High Court Cr.Misc. No.42990 of 2017(3) dt.21-09-2017 2/2 Learned counsel appearing on behalf of the petitioner has submitted that it was a free fight between two families and the petitioner also sustained grievous injury.

Considering the submission as above and the fact that the petitioner has no criminal antecedent, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Adapur (Nakardai) P.S. Case No. 205 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
