A counter affidavit is filed on behalf of the State respondent.
The writ petition was filed for a direction upon the respondents to pay the compensation at the market rate to the petitioner. After making submission at some length, Mr. Sharma states that the writ petition be permitted to be withdrawn enabling the petitioner to invoke appropriate provision of the Bihar Land Acquisition Act seeking reference of the matter to the court for adjudication of the claim with respect to the amount of compensation. The counsel for the State, considering the stand of the petitioner, has not objected to disposal of the case giving the petitioner the said liberty.
