The petitioner seeks bail in L.N.M.U. P.S. Case No. 149/2016, registered for the offences punishable under Sections 413, 414, 401, 420, 467 and 468 of the Indian Penal Code. The informant alleged that three persons were fleeing away after committing robbery of a motorcycle but the police chased them and arrested Gopal Kumar Ram and two persons, namely, Shrawan Ram and Suman Rai managed to flee away. Other accused persons were also apprehended on the spot, who were coming on different motorcycles. The accused disclosed that the petitioner is driving auto in the district Sitamarhi and he used to transport the stolen vehicle to Nepal.

It is submitted that the petitioner was arrested and from

Patna High Court Cr.Misc. No.55352 of 2016 (3) dt.28-02-2017 2/2 his house a motorcycle was recovered. The recovered motorcycle stands in the name of Rakesh Mahto. The petitioner has got no criminal antecedent and the motorcycle recovered from the possession of the petitioner is not stolen property. The petitioner is in jail since 28.06.2016.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about eight months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U. P.S. Case No. 149/2016.
