Counsel for the petitioner is permitted to make necessary correction in course of the day in the light of the Supplementary Affidavit filed on her behalf.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending hers arrest in a case registered under Sections 498A, 304B, 335, 336 and 120B//34 of the Indian Penal Code.

Allegation against the accused persons including the petitioner petitioner is of killing the daughter of the informant due to non-fulfilment of dowry.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.46536 of 2017(2) dt.22-09-2017 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is the mother-in-law of the deceased. She is separate in mess and property from the husband of the deceased. She has no concern with the husband of the deceased.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. case No.138 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
