The petitioner seeks bail in a case registered under Sections 366(A)/34 of the Indian Penal Code and Section 8 of Prevention of Children from Sexual Offences Act. Allegation is that the accused persons including the petitioner kidnapped the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. A petition has been filed by the informant of the present case in the court below. The said application is

Patna High Court CR. MISC. No.55873 of 2019(2) dt.03-09-2019 2/2 Annexure 2 to the present application. It has been stated that the victim has got married to co-accused Sagar Kumar. For the said reasons, the informant does not want to pursue with the present prosecution.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge (SC/ST/POCSO), Bettiah, West Champaran in connection with Majhaulia P.S. case No.248 of 2019.
