JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Victim Deo Narayan Mehta, a vegetable vendor had gone to market to sell the vegetables on 19.05.2015 at about 3:00 P.M. and since thereafter became traceless. Therefore, the instant case has been registered against unknown.

From the order impugned, it transpires that petitioner happens to be daughter-in-law of deceased. It has also been disclosed that her husband whose statement has been recorded under para-17 of the case diary had stated before the Investigating Officer that petitioner had made inculpatory extra-judicial confessional statement wherein she had deposed that her brother, Sanjay Mehta with the help of her son, Surendra Mehta kidnapped the deceased and then done to death.

Patna High Court Cr.Misc. No.49013 of 2015 (2) dt.09-11-2015 In the aforesaid facts and circumstances of the case, petitioner, Amala Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur (Balua) PS Case No. 96/2015.
