The petitioner seeks bail in connection with Kotwali P.S. Case No. 45 of 2015 registered for the offences punishable under Sections 370, 376 of the Indian Penal Code, Sections 4, 6 of Immoral Trafficking Act and Sections 3, 4, 5 and 7of POCSO Act. It is submitted that the main accused Chhaya Devi has been granted regular bail though with condition to deposit Rs. 5 lacs in cash by way of security and as such the petitioner is alleged husband of Chhaya Devi, he has also been made accused in this case though he is living separately from Chhaya Devi, at present, he is residing at Dhanbad and is in custody since 16.07.2015. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail

Patna High Court Cr.Misc. No.54526 of 2016 (2) dt.21-12-2016 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, (POCSO Act), Gaya in POCSO Trial No. 11 of 2015 arising out of Kotwali P.S. Case No. 45 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
