JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Narpatganj Police Station Case No. 265 of 2017, disclosing offences under Sections 341, 323, 353, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. As a matter of fact, scuffle took place between the parties on account of refusal for providing Anti-rabies injection but no over act has been done by the petitioners. No.37557 of 2017 (3) dt.08-09-2017 persons and he always creates nuisance and insult the patient, in this regard many people have gave application to the D.M and C.S. concerned, which is evident from annexure-2. Hence, the petitioners deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Narpatganj Police Station Case No. 265 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
