The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The prosecution case is that this petitioner took the grandson of the informant Rahul Kumar and subsequently Rahul Kumar came home with burn injury. Rahul Kumar disclosed that this petitioner after pouring kerosene oil set him on fire.

Learned counsel for the petitioner submits that the prayer for anticipatory bail has been renewed on the

Patna High Court Cr.Misc. No.54029 of 2015 (2) dt.16-03-2016 2/2 ground that the petitioner was not present at the relevant time on the place of occurrence. For the occurrence of 27.03.2014 the complainant was filed on 24.04.2014 which came to be registered as police case on 19.05.2014.

Considering the nature of accusation, this Court is not inclined to revise its earlier order. However, the delayed lodging of the case may be considered by the learned court below while considering the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Shivsagar P.S. Case No. 109 of 2014 pending in the court of learned Chief Judicial Magistrate, Rohtas.
