JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1327 (C) of 2017, disclosing offence under Section 406, 420, 504, 323 of the Indian Penal Code.
As per complaint case, petitioner has assured the complainant that in the inauguration of new Saloon, he called the Celebrity from the Film Industry and as such, complainant has deposited Rs.2,00,000/- . In support of that amount, banks slips has also been annexed with the complaint case. Apart from that petitioner has criminal antecedent also and he is engaged in such type of cases, which will appear from Para 3 of this petition.
Patna High Court CR. MISC. No.56462 of 2019(4) dt.22-10-2019 2/2 Submission of the learned counsel for the petitioner is that the whole allegation appears to be improbable, as no Celebrity has came of Rs.2,00,000/-. The allegation is false and concocted.
Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer for anticipatory bail. Having heard both sides, in view of the allegations and antecedent, I am not inclined to grant privilege of anticipatory bail to the petitioner. Hence this application is dismissed.
However, if petitioner surrenders and ready to pay the total amount within a period of one month, the learned court below shall consider this aspect of the matter while disposing of the bail application of the petitioner.
