JUSTICE BIRENDRA KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/148/149/353/341/323/385/379/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

The only non-bailable allegation is under Section 379 of the Indian Penal Code and Section 27 of the Arms Act.

There is general and omnibus allegation that the petitioners committed assault and theft as well as firing. The

Patna High Court Cr.Misc. No.36003 of 2017 (2) dt.10-08-2017 P2/ petitioners side had also lodged a criminal case against the informant and others earlier.

Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of Mr. S.K. Modi, learned Judicial Magistrate, 1st Class, Saharsa/successor Court in connection with Saharsa (Sadar) Police Station Case No. 524 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
