JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-08-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 419 and 420/34 of the Indian Penal Code.

Prosecution case in nutshell is that total Rs.11,00,000/- has been withdrawn on different dates illegally by co-accused Sumit Kumar @ Sugana in connivance with the petitioners.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

No.70330 of 2021(3) dt.08-08-2022 2/2 further submits that the main co-accused Sumit Kumar @ Sugana illegally withdraw Rs.11,00,000/- from the account of the informant on different dates and there is general and omnibus allegation against them that they connivance with the co-accused withdrawn the said amount. He further submits that the co-accused Sumit Kumar @ Sugana is in judicial custody. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Barh, Patna in connection with Mokama P.S. Case No. 67 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
