JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kadam Kuan P.S Case No. 367 of 2015 registered for the offences punishable under Section 302/120/(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that petitioner is not named in the F.I.R., during investigation the name of the petitioner has been disclosed by Anjum Eqbal, who is also not named in the F.I.R. except that there is nothing against the petitioner to show his involvement in the present case. It is submitted that petitioner is in custody since 05.09.2016, similarly situated co-accused Ashok Kumar @ Pintoo, Chhote Miyan @

Patna High Court Cr.Misc. No.54547 of 2016 (2) dt.23-12-2016 2/2 Aftab have also been allowed bail by another co-ordinate Bench of this Court.

In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the Sri M. Kumar Singh, learned Judicial Magistrate 1st Class, Patna, in connection with Kadam Kuan P.S. Case No. 367 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
