2. This application has been filed for restoration of Cr. Appeal (SJ) No. 1701 of 2023 which stood dismissed for default due to non-compliance of the order dated 23.06.2023.

3. For the reasons stated in the restoration application, the prayer for restoration is allowed and Cr. Appeal (SJ) No. 1701 of 2023 is restored to its original file.

4. Learned counsel for the petitioner submits that in compliance of the order dated 23.06.2023 he has filed notices in Cr. Appeal(SJ) No. 1701 of 2023 on 03.07.2023.

5. Office is directed to use the said requisites for

Patna High Court CR. MISC. No.65107 of 2024(2) dt.06-09-2024 2/2 issuing the fresh notices upon the respondent no.2.

4. Accordingly, the restoration application stands disposed of.
