JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Originally, informant filed complaint case which was converted into Sonbarsa P.S. Case No. 196 of 2013. There is specific allegation of gang rape against the petitioner and one unknown person but submission on behalf of the petitioner is that much prior to institution of the present case, father of the petitioner had given some land to the informant on lease and when the consideration amount of the aforesaid lease was demanded by the petitioner, the relation between petitioner and informant became strained and thereafter informant in collusion with enemies of the petitioner lodged this false case. It is further contended by him that according to prosecution case itself,

No.37239 of 2014 (3) dt.28-01-2015 the alleged occurrence took place on 15.06.2013 and the complaint petition was filed on 29.06.2013 and moreover, in course of investigation, independent witnesses stated that prior to institution of this case, there was love affair between informant and petitioner but subsequently, their relation became strained. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioner is in jail custody since 12.05.2014, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sonbarsa P.S. Case No. 196 of 2013.
