The petitioner is apprehending arrest in a case registered for the offences punishable under Section 30(a) of Bihar Excise and Prohibition Act, 2018.

It is alleged that from the house of the petitioner, 64.8 litres of Indian Made Foreign Liquor were recovered. It is submitted by the learned counsel for the petitioner that the recovery has been made from the joint family house of the petitioner. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that from the house of the petitioner, recovery has been made.

Patna High Court CR. MISC. No.55028 of 2019(4) dt.04-03-2020 2/2 Considering the nature of the recovery, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

However, learned Court below may consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nasriganj P.S. Case No. 120 of 2019 pending in the Court of learned 2nd Additional District Judge - cum - Special Judge, Excise, Rohtas at Sasaram.
