JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in connection with Alamnagar P.S.Case No. 112 of 2015 instituted under Section 302 of the Indian Penal Code.
It is alleged by the informant (Hafuz Nadaf) that his daughter,namely, Kasrun Khatoon had gone for grazing shegoat to Joranti Bahiyar on the alleged date of occurrence i.e. on 01.08.2015. It is further alleged that another daughter of the informant told the informant that someone has captured the shegoat, as a result, the informant sent Gulshan Khaoon for searching Kasrun Khatoon (deceased). In course thereof, Gulsan Khatoon found the dead body of Kasrun Khatoon in the Joranti Bahiyar. Thereafter the informant with the help of the villagers brought the dead body of his daughter to his house. At the fag end, the
Patna High Court Cr.Misc. No.49393 of 2015 (3) dt.08-02-2016 2/2 informant has stated that some unknown person has murdered his daughter with sharp cutting weapon and danda on her head and mouth.
It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. The petitioner is not named in the FIR. Subsequently in course of investigation the name of the petitioner has come on the basis of suspicion. There is no direct or indirect evidence to suggest the implication of the petitioner in the present case.
On behalf of the State, it is submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Uda Kishunganj, District- Madhepura in connection with Alamnagar P.S.Case No. 112 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
