In the present case, the petitioner has raised limited prayer for staying the Advertisement No.0606 dated 07.04.2006, which was published in the daily newspaper, namely, 'Dainik Jagaran' for the appointment of Pharmacists of total post 1116. In the writ application, it has been submitted that earlier there was advertisement on 26.08.1991 and 19.07.1991 for the appointment of Pharmacists and the posts were sent for selection to the Bihar Public Service Commission.
Learned counsel for the State has produced the order
Patna High Court CWJC No.33 of 2008 dt.09-11-2017 2/2 dated 16.09.2010 passed in Letters Patent Appeal No.399 of 2010, wherein this Court has taken into consideration the appointment of Pharmacists and dealt with the meaning of screening, in what manner the Pharmacists will be appointed and finally arrived to the conclusion that the screening is not the competitive examination, but only to test the efficiency of the person. It is in compliance of 2000 advertisement.
In such view of the matter, the petitioner is no longer interested with the outcome of the case and that too prayer has been made for staying the advertisement, which cannot be entertained only because the earlier notification was issued. Hence, this writ application is dismissed.
