For the Opposite Party/s : Dr. M.K.Gautam(APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 01-12-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Sunil Sah, in connection with Muffasil Police Station Case No. 96 of 2014, under Sections 413/414/34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Motihari, East Champaran.
Perused the above application and materials on record.
Heard Mr. Subodh Kumar Mishra, learned Counsel for the petitioner, and Dr. M.K. Gautam, learned Additional Public Prosecutor, appearing on behalf of the State. Considering the nature of incriminating materials available against the accused above-named and in view also of
Patna High Court Cr.Misc. No.50289 of 2015 (2) dt.01-12-2015 2/2 the fact that the petitioner is accused in several cases of theft and he is alleged to be the recipient of properties, which were obtained by unlawful means, this Court is of the view that at this stage, the accused above-named shall not be allowed to go on bail.
In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This bail application shall stand disposed of accordingly.
