2 The petitioner, who had retired on 30.04.2015 from the post of Store Keeper from K K M College, Jamui, has filed this writ petition for payment of retirement benefits, arrear of difference of salary, pension arrear along with the interest. 3 The petitioner states in the writ petition that he had earlier approached this Court by filing a writ petition being CWJC No 13130 of 2017 praying for payment of his retirement dues. The aforesaid writ petition was disposed of by an order dated 14.08.2018 wherein it was observed that from the counter

Patna High Court CWJC No.18716 of 2019(6) dt.15-02-2024 2/3 affidavit filed on behalf of the University, it transpires that the remaining admitted dues have been paid to the petitioner on 09.06.2018 and 12.07.2018. After having observed as above, liberty was granted to the petitioner to submit a representation before the Registrar of the University, if the petitioner is of the view that any admitted dues still remains unpaid. The University authorities were further directed to verify from the record and pass a reasoned order once such a representation is filed by the petitioner and on such verification, if any further payment was required to be made to the petitioner, the same shall also be paid to him within the next four weeks.

4 The University has filed a counter affidavit wherein, in paragraph 7 thereof, it has been pointed out that the petitioner has not filed any representation before the University authorities, as directed in the earlier writ petition being CWJC No 13130 of 2017 to enable the University authorities to make a verification of the records and if any dues are found in favour of the petitioner to pay the same.

5 No rejoinder by the petitioner has been filed controverting the statement made by the University authorities in the counter affidavit that the petitioner did not file any representation as directed by this Court in the earlier writ

6 In view of the above, this writ petition is disposed of with liberty granted to the petitioner to approach the University authorities by filing a detailed representation as directed vide order dated 14.08.2018 in CWJC No 13130 of 2017 for payment of the remaining retirement dues to the petitioner, if any. 7 As and when such a representation is filed by the petitioner, the University authorities are directed to verify and consider the same and do the needful in accordance with law within a period of four weeks from the date of receipt of such a representation along with a copy of the order passed in the instant writ petition.

8 Writ petition is disposed of with the above observation.
