ANJANA MISHRA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the Chairman of the Primary Agricultural Credit Society (PACS), is apprehending his arrest in connection with Paroo P.S. Case No.124 of 2016 for allegedly having committed the offence under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code. Learned counsel for the petitioner submits that as a Chairman of PACS, the petitioner has no role in the grant of Land Possession Certificate (LPC), which is done at the district level. It is only when the said LPC is produced before him, he forwards the same to the Bank for payment. No separate enquiry is required or conducted with regard to the L.P.C.

No.54737 of 2016 (2) dt.13-01-2017 2/2 Considering the nature of allegations made against the petitioner and also because the amount is paltry and is only for Rs.2736/- and further because the petitioner is having no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Aditya Kumar Singh, learned Judicial Magistrate 1st Class, Muzaffarpur, in connection with Paroo P.S. Case No.124 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
