Petitioner was granted bail vide order dated 22.09.2011 passed in Cr. Misc. No. 16486 of 2011 but he committed misuse of privilege of his bail as a result whereof his bail bond was cancelled on 18.02.2012. However, petitioner could be remanded in this case on 26.11.2016 and since then he is languishing in jail custody.

Considering the aforesaid facts as well as this aspect of the matter that petitioner has already been punished for his misdeed by remaining in jail custody for near about four months, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge, Bhagalpur in connection with Session trial no. 701 of 2016

Patna High Court Cr.Misc. No.55694 of 2016 (2) dt.22-02-2017 2/2 arising out of Ekchari P.S.Case No. 13 of 2008, subject to condition that one of the sureties must be close relative of the petitioner who shall swear an affidavit to this effect as to how he/ she is related with the petitioner.
