The petitioners seek bail in connection with Tariyani P.S. Case No.25 of 2013 registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 447, 448, 504, 307 and 302 of the Indian Penal Code read with Sections 3(1) (x) of the SC/ST Act. The accusation is of causing head injury to Gagan Ram by the co-accused, Raju Singh, Sanjay Singh and Vikash Singh through 'Lathi' as a result of which he fell down and died. At that time, the petitioners and other accused also rushed at the
Patna High Court Cr.Misc. No.50905 of 2015 (2) dt.18-12-2015 2/2 place of occurrence and assaulted others.
Learned counsel appearing on behalf of the petitioners submits that there is specific allegation of causing head injury to the deceased through 'Lathi' against the co-accused, Raju Singh, Sanjay Singh and Vikash Singh. There is general allegation against the petitioners and others to cause injury to others at that time. It is further submitted that the similarly situated co-accused, Ranjeet Kumar Singh, has already been granted bail by a coordinate Bench of this Court vide order dated 30.09.2013 passed in Criminal Misc. No.37473 of 2013. The petitioners are in jail custody since 07.09.2015.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Taryani P.S. Case No.25 of 2013.
