Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks from today.
The Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 325, 379, 307, 354 (B) of the Indian Penal Code. The prosecution case is that allegation of theft is against the petitioner. The co-accused person entered the house of the informant and molested and assaulted her with lathi. Learned counsel for the petitioner has submitted that no incriminating article has been recovered from the conscious
Patna High Court CR. MISC. No.69860 of 2021(2) dt.07-06-2022 2/2 possession of the petitioner or her home. There is no allegation of assault against the petitioner as stated in FIR. The petitioner has no criminal antecedents as stated at para 3 of the bail petition.
Learned A.P.P. for the State has opposed the bail petition of the petitioners.
Considering the aforesaid facts and circumstances, let the above named petitioner who is a lady, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in connection with Sultanganj P.S. Case No. 182 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
