Learned counsel for the petitioner has submitted that earlier the prayer for bail of the petitioner was allowed with condition that he will surrender within a period of four weeks and make prayer for regular bail, which will be considered by the learned Special Judge as directed in order dated 30.06.2017 passed in Cr. Appeal (S.J.) No.1289 of 2017, however, it appears that the petitioner has not surrendered within the period as directed and now this application has been filed since he could not appear before the learned Special Judge within the period as directed. Heard learned A.P.P.
In view of the facts and circumstances, as stated above, I am not inclined to interfere with the order dated 30.06.2017 passed in Cr. Appeal (S.J.) No.1289 of 2017.
Patna High Court Cr.Misc. No.39905 of 2017 (2) dt.30-08-2017 2/2 Let the petitioner surrender before the learned Special judge and make prayer for regular bail. With the aforesaid modification, this application is dismissed.
