JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2017 The application is for grant of bail in connection with Narpatganj P.S. Case No. 204 of 2016 registered for the offences under sections 302 and 201/34 of the Indian Penal Code. It has been submitted on behalf of petitioner that allegation against the petitioner is that on 15.07.2016 at about 12.00 midnight, he came with his Tempo at the door of the deceased and after parking it, called his nephew Anil Mandal and enquired about his father and thereafter, he went away along with the deceased but thereafter the deceased did not return. It has come during investigation that the deceased and the accused, both had illicit relations with wife of one Madhu Thakur, which is the cause of the death of the deceased. There is nothing against the petitioner, who has remained in custody for about four months. The charge sheet has also been submitted in this case.

Patna High Court Cr.Misc. No.54750 of 2016 (3) dt.30-01-2017 2/2 Heard learned A.P.P. also. Learned A.P.P. could not controvert the facts as stated by the petitioner. Having heard both sides. In view of the fact that there is a story of last seen with the petitioner, there is nothing against the petitioner and he has no criminal antecedent, let the petitioner, Tanjit Mia @ Tamjeet, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No.

204 of 2016 with a condition that (i) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of concerned court and (ii) the petitioner will cooperate in the disposal of the case and make himself available on each and every date as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, will make liable for cancellation of his bail bonds. With the above observation, this petition is allowed.
